On 7 February 2024, the Court of Appeal of #Montenegro granted the appeal of Do Kwon's legal team, effectively overturning the extradition decision. The case was sent for reconsideration.
According to the court ruling, the extradition order to South Korea or the US was issued with numerous irregularities. The document said the reasons for the verdict were unclear.
In addition, in the simplified extradition procedure, the court, not the justice minister, is responsible for determining the country to which the convict will be transferred. In addition, the authorities did not take into account the proper application procedure of the authorised authorities of South Korea and #USA in reaching their decision.
As a result, the case was returned to the lower court for further consideration.
Recall that in late November 2023, the media reported that the decision to extradite #Do Kwon had been made. However, in mid-December, the Court of Appeal cancelled this decision due to the lack of direct testimony from the convict himself. In January 2024, Do Kwon's legal team announced their intention to appeal the decision, as the previous decision was only an interim measure.
The other day, it was revealed that Han Jang Joon, former CFO of #Terraform Labs, was indeed extradited to #South Korea. He was detained together with Do Kwon while trying to leave Montenegro on forged documents.
